MOBILE APP PRIVACY POLICY

This is our Privacy Policy. You should read it because it contains important information about how we collect and use your information when you use the Show Up Mobile Application (the “App”). The most important things to know are:

Introduction

Show Up Onstage, LLC (“Show Up Onstage,” “us,” “our,” or “we”) respects your privacy and is committed to protecting it through our compliance with this Privacy Policy. This Privacy Policy explains how we collect, use, maintain, disclose, and safeguard (collectively, “process”) your personal information that you provide to us while using the App or that we may otherwise collect from or about you in connection with the App, as well as your choices and rights with respect to your personal information. Please read this Privacy Policy carefully.

Important Notice for Parents/Guardians of Children Under 13 Years

Our App is designed for and marketed to both adults and children. Protecting the children who use the App is our priority. We require the express consent of parents or guardians (referred to throughout as “parent”) of any child under 13 years of age who wishes to use the App to allow parents to observe, participate in, and/or monitor and guide your child’s use of the App. 

Please therefore read this policy carefully as parents will be legally contracting on behalf of, and responsible for, your designated child.

Certain features of the App, if activated, will involve the collection and processing of the personal information of children. We require that the parent of a child under 13 years old provides permission and agrees to this Privacy Policy before that child can use the App. We also reserve the right to verify that the person providing such consent does, in fact, hold parental responsibility for the child. If you believe that a child under age 13 has provided personal data on the App without parental consent, please contact us immediately and we will take action to identify the information provided and, if required, remove such information from our records.

Important Notice for Parents/Guardians of Children Under 13 Years

Children under 13 years of age are unable to use the App without verifiable parental consent. To register as a user of the App, individuals will be asked for their date of birth. Any individual who enters a date of birth indicating they are under 13 years of age will be unable to register. 

Accounts for children under 13 years of age can only be created by a parent who has a registered account on the App. As part of the registration process, parents will be required to upload a copy of their driver’s license, which will be checked against a database to confirm their identity. Once confirmed, parents will be able to provide consent agreeing to this Privacy Policy and our Terms of Use on behalf of their child and also allowing their child to create an account on the App. Once verification of the parent is complete, the App will not store the data received from the parent’s driver’s license. 

Parent Notifications and Control over In-App Permission

We will notify the parent of their child’s in-App activity via in-App notifications and via email sent to the email address provided to us by the parent at the point of registration. Such notifications will include when the child:
  • Registers for the App; 
  • Is enrolled in any production through the App;
  • Uploads anything within the App;
  • Makes any change to their App profile or Registration.

Description of Parental Rights

A parent or legal guardian may review their child’s personal information in the App at any time and can request that we correct or delete the personal information of their child or request that we delete their child’s registered account by emailing us at support@showuponstage.com with the subject line “Privacy Policy”.

Collection of Your Personal Information

We collect personal information from you that you voluntarily give us or that is generated through or in connection with your use or access of the App. We do not require users of the App, including children under 13 years old, to disclose more personal information or other information than reasonably necessary to use our Services. This information may include the following.  

Information You Provide

  • Information you provide when you register on the App, including your name, physical address, phone number, email address, date of birth, gender, preferred pronouns, relationship to child, and professional information.
  • Your photograph if you choose to upload a profile picture.
  • Information included in your resume (e.g., past theatre performance or other experience in theatre) if you choose to upload your resume to the App.
  • Information generated through your use of the App such as your enrollment as a student at your school, your participation in certain theatre productions, your class schedule, your production or theatre schedule, and any additional information you or your school administrators may enter into the App. 
  • Information provided to us by your school.
  • Records and copies of your correspondence, including your name and email address, if you utilize the messaging feature through the App.
  • Information generated through your download and use of the App that we receive from mobile app stores. 
  • Details of any other activities you carry out through the App.

Information Collected Automatically

When you download, access, and use the App, we may automatically collect your personal information through cookies, pixels, web beacons and other similar technologies. 
  • Usage Details. When you access and use the App, we may automatically collect certain details of your access to and use of the App, including traffic data, location data, logs, and other communication data and the resources that you access and use on or through the App. 
  • Device Information. We may collect information about your mobile device and internet connection, including the device’s unique device identifier, mobile device advertising identifier, operating system, browser type, and mobile network information.
  • Stored Information and Files. The App also may access metadata and other information associated with other files stored on your device. This may include, for example, photographs, audio and video clips, personal contacts, and address book information.
  • Location Information. The App may collect real-time information about the location of your device, subject to your consent.
  • Information provided to us by your school.
  • Records and copies of your correspondence, including your name and email address, if you utilize the messaging feature through the App.
  • Information generated through your download and use of the App that we receive from mobile app stores. 
  • Details of any other activities you carry out through the App.
If you do not want us to collect this information, do not download the App, or delete it from your device. Your continued use of the App indicates your consent to our Terms of Use and to this Privacy Policy.
In addition to the personal information listed above, photos or videos may be uploaded to the App by registered users of the App. To access photos and videos, the App may require you to grant access to your phone gallery. 
PLEASE NOTE THAT YOU MUST HAVE PERMISSION TO USE THE PERSONAL INFORMATION OF ANYONE ELSE FEATURED IN ANY CONTENT YOU UPLOAD TO THE APP (INCLUDING IN ANY VIDEO AND/OR PHOTO). 
USERS ARE NOT PERMITTED TO USE THE PERSONAL INFORMATION OF ANY CHILDREN UNDER 13 YEARS OLD WHO ARE NOT REGISTERED USERS IN ANY CONTENT YOU PROVIDE TO US (INCLUDING IN ANY VIDEO AND/OR PHOTO).

Use of Your Personal Information

We use the personal information we collect from and about you and your device for the following purposes:
  • For account verification: To verify your age and, if under 13 years old, to verify if you have parental consent.
  • To provide services: To provide services to you based on your registered account.
  • To manage your account: To manage your registration as a user of the App. The personal information you provide can give you access to different functionalities of the App that are available to you as a registered user based on your type of account (e.g., teacher, student, parent).
  • To contact you: To contact you by email, telephone calls, SMS, or other equivalent forms of electronic communication, such as a mobile application's push notifications regarding updates or informative communications related to your registered account, including the security or administrative updates, when necessary or reasonable for their implementation.
  • Legal purposes: Where we have legal obligations to process the personal information and for legal proceedings and government investigations (such as pursuant to warrants, subpoenas, and court legal orders).
  • Internal investigations: For internal investigations of possible misconduct or failure to comply with our Terms and Conditions.
  • Security: To help maintain the safety, security, and integrity of the App.
  • For internal administrative purposes, such as auditing, data analysis, identifying usage trends, and research to improve the App. This includes processing for purposes of statistical analysis, including Google Analytics.

Disclosure of Your Personal Information

We will not disclose your personal information outside of what is stated in this Privacy Policy or without your consent. We will disclose your personal information as follows: 
  • To other registered users of the App. When you register a user account on the App, your account will become visible to other registered user accounts connected to your school’s account. 
  • To service providers. We may engage with service providers. In these instances, service providers are subject to contracts requiring them to uphold the same privacy protections that are outlined in this Privacy Policy. 
  • To your school. When you register a user account on the App, your account becomes active within your school’s account, enabling them to access other user accounts. 
  • For legal purposes. We will disclose personal information as required by law. 
  • To a buyer or other successor. In the event of a merger, divestiture, restructuring, reorganization, dissolution or other sale or transfer of some or all of Onstage’s assets, we will disclose the personal information as part of the sale or transfer of the App.
  • To protect us and others. If we believe disclosure is necessary or appropriate to protect the rights, property, or safety of our company, our customers, or others, we will disclose personal information as necessary. This includes exchanging information with other companies and organizations for the purposes of fraud protection.
  • With your consent. With your consent, or for children under 13 years of age with the parent’s consent, we may disclose personal information. 

Cookies and Other Similar Technologies

We collect personal and other information using digital tracking tools, such as cookies, web beacons and similar tracking technologies, when you use the App. We also partner with third parties that collect information this way. These third parties may place similar tracking tools on the App. The cookies and similar tracking technologies we and our third-party partners may use include the following:
  • Cookies. A cookie is a small text file that the App sends to your connected device to identify your browser or to store information or settings. Your browser may provide the ability to be notified when you receive certain types of cookies and how to restrict or disable certain cookies. Flash cookies generally can be disabled only by accessing Adobe Flash settings (information available here) placed on your device. Cookies can be “Persistent” or “Session” Cookies. Persistent Cookies remain on your mobile device when you turn off the App, while Session Cookies are deleted as soon as you close the App. Cookies include “first-party” and “third-party” cookies. First-party cookies are cookies we send to your device when you access the App. Third-party cookies are sent to your device by a third-party when you access the App.
  • Pixels, web Beacons, gifs. Certain sections of the App, and our emails, may contain small electronic files that permit us to understand and track how users interact with the email and with the App. Pixels may also send information on these interactions to our third-party partners and enable them to place cookies on your device.
  • Server logs. Server logs refer to the information automatically recorded by a server such as Internet Protocol (IP) address, browser type, browser language, date and time of your request, and any cookies that may uniquely identify your browser.
  • Software development kits. Software development kits (SDKs) operate in the mobile app environment and function like third-party cookies and pixels. Instead of using cookies and pixels tags, we may install pieces of code provided by third parties into the App for these third partis to monitor and analyze the use and performance of the App.
  • Statistical identifiers. Statistical identifiers refer to identifiers created using your device information and certain server log information. This information, collectively, makes your browser or device sufficiently distinct for a server or similar system to reasonably determine that it is encountering the same browser or device over time.  Statistical identifiers enable us to uniquely identify your browser or device for the same purposes as cookies.

  • Functionality

    We use a set of cookies that are optional for the App to function. They are usually only set in response to information provided to the App to personalize and optimize your experience, such as to avoid you having to re-enter your preferences every time you use the App. These cookies allow us to remember choices you make when you use the App, such as remembering your login details or language preference.
  • Analytics

    These cookies are necessary for the App to function and cannot be switched off in our systems. These cookies are essential to provide you with services available through the App and to enable you to use some of its features. They help to authenticate users and prevent fraudulent use of user accounts. These cookies include notice acceptance cookies which identify if users have accepted the use of cookies on the Services.
  • Advertising

    We use cookies to make our ads more engaging and valuable to the App users. Some common applications of cookies are to select advertising based on what’s relevant to a user; to improve reporting on ad campaign performance; and to avoid showing ads the user has already seen.

Your Cookie Choices

Most browsers are set to accept cookies by default. However, browsers typically allow individuals to remove or block browser cookies if they choose. Your Choices

Access or update your account information. If you have registered for an account with the App, you may review and update certain personal information in your account profile by logging into the account. You may also request to access and update your personal information by contacting us as described in the Contact Us section below. For record keeping and compliance purposes, we will retain certain information collected from or about you in conjunction with our Services, products and other commercial transactions.
Request deletion of your account information. You may request that we delete your account information at any time. Please see Contact Us below. If you choose to delete your account, you will no longer be able to use the App.   
Opt-out of marketing communications. You may opt out of marketing-related emails by following the opt-out or “unsubscribe” instructions located at the bottom of the email. You will continue to receive service-related and other non-marketing emails. If you receive marketing text messages from us, you may opt out of receiving further marketing text messages from us by replying “STOP” to our marketing message.

Advertising choices. You may opt-out of interest-based advertising. See the Cookies and Other Similar Technologies section above for more information.

Security | Data Retention

We have implemented reasonable technical, administrative and physical safeguards designed to secure your personal information from accidental loss and from unauthorized access, use, alteration, and disclosure. The safety and security of your information also depends on you. You are responsible for keeping the password associated with your registered account confidential. We ask you not to share your password with anyone.
The transmission of information via the internet is not completely secure. Although we do our best to protect your personal information, we cannot guarantee the security of your personal information on the App. Any transmission of personal information is at your own risk. We are not responsible for circumvention of any privacy settings or security measures contained on the App.
We will retain your personal information only for as long as is necessary for the purposes set out in this Privacy Policy. We will retain and use your personal information to the extent necessary to comply with our legal obligations (for example, if we are required to retain your data to comply with applicable laws), resolve disputes, and enforce our legal agreements and policies. 

Links to Other Websites 

The App may contain links to websites and services that are not operated by us. If you click on a third-party link, you will be directed to that third party’s site. We strongly advise you to review the privacy policies of every site you visit. We have no control over and assume no responsibility for the content, privacy policies, or practices of any third-party sites or services.

Changes to Our Privacy Policy

We reserve the right to modify our Privacy Policy at any time and without prior notice. It is our policy to post any changes we make to our Privacy Policy on this page. The date the Privacy Policy was last revised is identified at the top of the page. We encourage you to review our Privacy Policy regularly to check for any changes.
